City of Marinette Alderperson, Doug Oitzinger, has filed a lawsuit against the City of Marinette and city council alleging that the city violated the open meetings law on two occasions. According to court documents obtained by Bay Cities Radio, Oitzinger alleges that the Marinette Common Council went into closed session on October 6, 2020, to discuss negotiations and review of an agreement with JCI/TYCO, which the Council then voted in open session to approve without further discussion. Oitzinger says, “there was no need to go into a closed session, as there was no discussion of negotiation strategy in the closed session.” Then on October 7, 2020, the Common Council went into closed session to discuss with legal counsel the status of a water supply alternative analysis and receive a report form the civil engineering firm about the status of its analysis. Again, Oitzinger says, “the council did not need to go into closed session because there were no competitive or bargaining interests discussed, nor did they need to go into closed session to receive a report from the civil engineering firm.” At this time there is no known court date.
